THIS ONLINE COURSE IS FOR TRAFFIC VIOLATORS ONLY:

Course content is limited to traffic violator curricula approved by the Department of Motor Vehicles. Students taking this online course include traffic offenders, repeat traffic offenders, adults, and teenagers, and those who have and those who have not been referred by a court. Instructor training, business regulatory standards, and Vehicle Code requirements of traffic violator schools are not equal to the training, standards, and Vehicle Code requirements of licensed driving schools (California Vehicle Code Section 11200(b)(1)).

EXEMPTIONS TO MASKING A TRAFFIC SAFETY VIOLATION:

California courts will report traffic safety violations as convictions or a driver's record. If the driver is eligible and complets a TVS (Traffic Violator School) course, this conviction will be masked on the driver's record. Once a conviction is masked on a driver's record, it will not become unmasked nor assessed a violation point.

A TVS conviction will NOT be masked if:

  • There is a prior TVS dismissal/conviction within the previous 18 months.
  • The driver holds a California or from another state a commercial driver license or was operating a commercial vehicle at the time of the violation. "Commercial driver's license" means a driver's license issued by a state or other jurisdiction, in accordance with the standards contained in Part 383 of Title 49 of the Code of Federal Regulations, which authorizes the license holder to operate a class or type of commercial motor vehicle.

A driver is required to obtain an endorsement issued by the department to operate any commercial motor vehicle that is any of the following:

  • A double trailer.
  • A passenger transportation vehicle, which includes, but is not limited to, a bus, farm labor vehicle, or general public paratransit vehicle when designed, used, or maintained to carry more than 10 persons including the driver.
  • A schoolbus.
  • A tank vehicle.
  • A vehicle carrying hazardous materials, as defined in Section 353, that is required to display placards pursuant to Section 27903, unless the driver is exempt from the endorsement requirement as provided in subdivision (b). This paragraph does not apply to any person operating an implement of husbandry who is not required to obtain a driver's license under this code. (b) This section does not apply to any person operating a vehicle in an emergency situation at the direction of a peace officer pursuant to Section 2800(1).

The driver has not paid a deposit of fees or bail, and has not pled guilty or no contest, or has not been convicted by the court of jurisdiction would not be eligible to have his or her violation masked on their record.

The violation will not be masked if the conviction would result in a violation point count of more than one point. (A list of two point violations can be found on the DMV's website)

Some examples of two point violations:

  • Reckless driving or hit-and-run driving
  • Driving under the influence of alcohol/drugs
  • Driving while driver license is suspended or revoked

We are required by the court to provide specific information for all participants enrolling in the course to enable us to report completion of the course to the appropriate court.
